California Assembly Bill 886
Amends Civil Code sections 1185 and 1189.
Amends Government Code sections:6203, 8201.1, 8201.2, 8201.5, 8202, 8206, 8213.5, 8213.6, 8214.1, 8214.2, 8214.15, 8221, 8225, 8228, 8228.1.
Adds sections 8214.21, 8214.23 to the government code relating to notaries.

Bill changes summary:

Bill eliminates personal knowledge as an option to identify a signer. Failure to obtain satisfactory evidence would subject the notary to a civil fine not to exceed $10,000. Notarial certificate wording will be changed accordingly.

Bill prohibits a notary from using a commercial mail receiving agency or post office box as a principal place of business.

Bill adds requirement for notary applicants to provide a photo when submitting an application.

Bill adds penalty for failure to provide the Secretary of State with a notification of change of address or name in which case a notary may incur a fine of not more than $500.

Bill changes fine provisions and civil penalties for acts such as willful failure to provide access to the sequential journal to a requesting peace officer or failure to obtain a required thumbprint from a signer.

Bill adds power-of-attorney signer as required to provide a thumbprint in the sequential journal.

Bill requires a peace officer to have probable cause to seize a sequential journal and requires the peace officer to notify the Secretary of State within 24 hours of journal seizure the name of the notary public who is the owner of the journal.

Bill authorizes peace officers and public prosecutors to enforce specific provisions and also notify the Secretary of State when a civil penalty is imposed for violations.
